TRAVEL PLANNING:

Travel planning with Gather Away is a collaborative process. To start, we ask that you take the time for a phone call so we can get to know more about you, your interests, and your travel vision. You can rely on us to listen, discuss options, and provide well-informed recommendations. We will then take the time to craft an exclusive itinerary which can take us anywhere from 5-10+ days due to the custom nature of your trip. All of our proposals can be considered a starting point from which we can continue to make changes until you are completely satisfied. We do reserve the right to charge a planning fee in the initial stages of planning which is applied towards the cost of your trip.

PAYMENT & CANCELLATION POLICY:

Since all Gather Away trips are custom designed, the payment and cancellation policies will vary based on your destination and the services you select to include. Our payment terms typically require a 25% non-refundable deposit to confirm your trip. No travel arrangements will be confirmed until deposits are received. The final balance for your trip is due 60 days prior to travel, although this can vary depending on the confirmed services. Cancellation penalties will begin to apply at the final balance due date, in addition to the non-refundable deposit paid. Gather Away will provide cancellation policies as well as payment deadlines prior to confirmation of your itinerary and will be detailed on your invoice.

TRAVEL INSURANCE:

Gather Away strongly recommends that all travelers purchase travel insurance that covers the cost of your travel. For certain destinations, proof of insurance may be required at a minimum for medical evacuation. There are many insurance plans, so it is important to review options and determine the right coverage for you. We can provide recommendations to trusted travel insurance providers for you to contact directly.

TERMS & CONDITIONS:

These Terms and Conditions (“Agreement”) apply to and control any travel services offered by or through Gather Away, LLC or any of its Affiliates (together and in the alternative, “we”, “us”, “our”). “You”, “your”, and “guest” means each program participant. These terms and conditions apply to each program participant joining in travel services arranged by Gather Away.

Release. Gather Away does not own, operate or control any entity that provides, or is to provide, any goods or services for your trip including, without limitation, ownership or control over any lodging facilities; airline, bus, vessel or other transportation companies; food service providers; local ground operators, outfitters or guides; safari operators; equipment suppliers; organizers of optional excursions; entertainment providers; etc., including, without limitation, various entities that may utilize the Gather Away name. As a result, you understand that Gather Away is not responsible for any negligent or willful act, or failure to act, of any such person or entity or of any other third party and is not liable for any direct, indirect, consequential or incidental damage; injury, loss, or damage to person or property; illness, death, delay, inconvenience or irregularity of any kind in connection with the trip that may be occasioned by or resulting from any act or omission beyond its control, including, but not limited to, any willful or negligent act, failure to act or breach of contract of any third party, acts of God, force majeure, acts of war or civil unrest, acts of government, insurrection or revolt; strikes or other labor activities; criminal or terrorist activities of any kind or the threat thereof; climate conditions; high altitude; overbooking or downgrading of accommodations, or structural or other defective conditions in hotels or other lodging facilities; the operation of and/or mechanical or other failure of any means of transportation or for any failure of any transportation mechanism to arrive or depart in a timely or safe manner; dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort; dangers incident to any recreational activities; epidemics or the threat thereof; sanitation problems, including without limitation risks associated with food or impure water; lack of access to or quality of medical care; difficulty in evacuation in case of a medical or other emergency; stolen, lost, or misplaced luggage or property; theft or break-ins into vehicles, lodging rooms or elsewhere; or for any other action or omissions of third parties, or conditions beyond the control of Gather Away. Gather Away is not responsible for risks of exposure, and any health or other implications associated with exposure, to the covid-19 virus before, during or after travel.

Additionally, you release Gather Away from their own respective negligence and assume all risk thereof. You agree to follow all rules, guidelines, policies, regulations and recommendations (the “Rules”) made by Gather Away, and to indemnify Gather Away for any costs or losses that are caused by or arise in connection with your failure to follow any such Rules of which you have been made aware whether verbally or in writing.

Itineraries. Accommodations and arranged excursions are subject to change or substitution at any time due to unforeseen circumstances or circumstances beyond Gather Away’s control. Every reasonable effort will be made to operate programs as planned, but adjustments, substitutions and changes may occur after the final itinerary has been issued. 

Not Included. Program prices only include the expenses for services specifically noted in the itinerary. Services not specifically included, if applicable, are your sole responsibility to pay and satisfy. 

Health and Fitness to Travel. You represent and warrant to Gather Away that you have no physical, mental or other condition, impairment or disability that may or will cause or create a risk of injury or other hazard to yourself or others in respect to any aspect of the program you have selected. 

Covid-19. You are aware that while traveling to or from your trip, you might be exposed to COVID-19 and that the Centers for Disease Control and Prevention may have warnings concerning the same. You certify that you understand and accept the risks of exposure by participating in this activity. Therefore, you assume and accept full responsibility for yourself, including all minor children in your care, custody and control, for bodily injury, death, and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified and agree to hold harmless Gather Away and the Outfitter/Guide from any such developments. You understand and agree that if the trip is terminated early because you or another participant becomes COIVD-19 symptomatic, there will be no refund. Any expenses incurred, including but not limited to quarantine, testing or retesting and medical expenses, will be your own responsibility.

Force Majeure. In addition and without limitation, Gather Away shall not be liable for any injury, loss, death, inconvenience, delay or damage to personal property in connection with or resulting from acts of God, illness, disease, acts of war, riot, civil unrest, insurrection or revolt, flood, cyclone, hurricane, fire, earthquake or other natural occurrence, weather event or disaster, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft, vessels or other means of transportation, termination or cancellation of services by suppliers for any reason or for failure of timely arrival or departure.

Travel Advisories and Warnings. It is the sole responsibility of each guest to stay informed about the most current international travel advisories and warnings by visiting the U. S. State Department’s travel website at http://www.travel.state.gov or by contacting the U.S. State Department directly. You hereby agree, individually and on behalf of your marital community, heirs, estates, personal representatives, executors and assigns, to assume, and to defend, indemnify and hold Gather Away harmless from and against, all actual or potential personal injuries, death, property damage and other loss or casualty arising from or related to events in the country of your Gather Away travel program.

Travel Documents. For U.S. citizens, valid passports are required for travel to foreign destinations and some countries require specific visas prior to entry. It is your sole responsibility and obligation to obtain and verify that you have all required travel documents, including visas, for your nationality necessary and appropriate for the program location(s) and sufficient blank pages in your passport for visas and immigration stamps. Gather Away is not liable, and expressly disclaims all such liability, for any expenses or costs you may incur due to your prohibition or restriction from entering a country on the program itinerary or reentering the United States at the conclusion of the program.

Photos and Videos. Gather Away and its representatives may make photographic or video recording(s) during a program, which may include images of you and/or your Dependent(s) (if any). You, individually and on behalf your Dependent(s), hereby agree and grant to Gather Away a limited, non-exclusive, irrevocable, worldwide, perpetual, royalty-free right, license and release, with right to sub-license, to use these with the limited purpose of promoting and marketing the services of Gather Away. 

Arbitration. Any controversy or claim arising out of or relating to any services or products offered or obtained through Gather Away, including without limitation, any claim related to bodily injury, death or property damage, shall be adjudicated and conclusively settled and resolved by binding arbitration.

Other. Dates, program details and costs, although given in good faith and based on tariffs, exchange rates and other information current at the time of printing, are subject to change at any time any additional expense or cost will be paid by the individual guest. 

Gather Away may at any time and without notice modify these terms and conditions, and any modification so made will be effective for all reservations made from and after the posted Effective Date.

In the event any term in these terms and conditions is deemed unenforceable by a court of competent jurisdiction, the unenforceable clause shall be interpreted to give effect to the parties’ intentions to the greatest enforceable extent, and all other provisions hereof shall remain fully enforceable according to their terms. 

Acceptance of Contract: ISSUING PAYMENT FOR TRAVEL SERVICES TO GATHER AWAY CONSTITUTES YOUR ACKNOWLEDGEMENT OF AND AGREEMENT TO THE TERMS AND CONDITIONS SET FORTH ABOVE AND IN MORE SPECIFIC TOUR DOCUMENTS.
